Representation of Health Care Providers

Our attorneys have represented hospitals, physicians, physician assistants, nurses, nursing homes, physical therapists, home health agencies, and other health care professionals in litigation, administrative, and non-litigation matters, including:

  • Health care claims
  • Contracts and transactions
  • EMTALA issues
  • Medical staff affairs
  • Practitioner peer review proceedings
  • Credentialing
  • Licensing
  • Patient rights
  • Informed consent
  • Confidentiality
  • HIPAA Privacy Rule and HITECH Act compliance
  • Billing disputes
  • Fraud and abuse (Stark & AKS)

We have successfully represented health care clients at administrative proceedings before their respective licensing boards. We have represented medical committees and individual practitioners in peer review matters governed by the Health Care Quality Improvement Act of 1986 and various state statutes affecting the ability of a practitioner to exercise his or her privileges to include applicable provisions of the Medical Practice Act and Nurse Practice Act.  One of the Firm’s cases was featured in Texas Medicine.  In that matter the Firm was successful forcing a hospital to issue a retraction letter for a wrongfully peer reviewed physician.

Our trial lawyers have successfully defended health care providers and institutions against health care liability claims in state, federal and appellate courts in South Texas for more than 40 years. Our firm has successfully defended class action lawsuits filed against hospitals and hospital systems.

We are assisted by a registered nurse who aids in evaluating medical-legal issues in professional liability cases. One of our partners has been board certified in Health Law by the Texas Board of Legal Specialization since 2003 and has served on the Texas Board of Legal Specialization Health Law Advisory Commission and the TBLS Health Law Exam Commission. This partner is also a member of the Texas Health and Human Services Commission’s Texas Medical Disclosure Panel (TMDP) established by § 74.102 of the Texas Civil Practice and Remedies Code and is a Member of the State Bar of Texas Committee on Pattern Jury Charges (Red Book) for Malpractice, Premises and Products (2021 through 2024).

We have assisted clients conduct internal investigations in order to assess compliance with state and federal health care program requirements and have assisted clients self-disclose to the Texas Health and Human Services Commission’s Office of Inspector General as well as the Office of Inspector General for the U.S. Department of Health and Human Services.
